AGC Wins Case Based on Unique Tort Claims Act Argument

Alvarez-Glasman & Colvin’s Senior Partner, Roger A. Colvin, along with AGC Partner Rick R. Olivarez, recently obtained summary judgment in favor of the firm’s client, the City of Pico Rivera, in a breach of contract action which was filed in the Norwalk Superior Court.

Mr. Colvin and Mr. Olivarez argued that Plaintiff’s entire action was “claims barred” under the California Tort Claims Act. The case involved a unique legal issue as to when Plaintiff’s cause of action “accrued” against the City under the Tort Claims Act.

At the summary judgment hearing held on April 17, 2009, the Honorable Raul A. Sahagun agreed with Mr. Colvin’s argument that the Plaintiff had waited too long to file a claim for damages against the City of Pico Rivera and was thus barred from bringing this action. This ruling came on the eve of trial and resulted in a substantial savings for the City as the case was projected to be a rather lengthy trial.
